Terms of Service

By accessing or using the MazalDay platform (hereinafter "the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not accept these terms, you must not use the Platform.

These Terms constitute a legally binding agreement between you and MazalDay Ltd. ("MazalDay", "we", "our"). Use of the Platform implies unreserved acceptance of these Terms.

In these Terms:

• User: any individual or legal entity accessing the Platform
• Provider: event professional registered on the Platform offering their services
• Client: user seeking providers to organize an event
• Content: texts, images, videos, reviews and any information published on the Platform
• Services: all features offered by the Platform
• Account: personal space created by the User on the Platform

MazalDay is a platform connecting event service providers with people wishing to organize events (weddings, Bar/Bat Mitzvah, corporate events, etc.).

The Platform allows you to:

• Search and discover providers by category and location
• View profiles, portfolios and reviews of providers
• Contact providers directly
• Manage a provider profile (for professionals)

MazalDay is not a party to contracts concluded between Providers and Clients. We act solely as an intermediary facilitating connections.

To access certain features, you must create an account. You agree to:

• Provide accurate, complete and up-to-date information
• Maintain the confidentiality of your login credentials
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

We reserve the right to suspend or delete any account in case of violation of these Terms or suspicious activity.

Providers agree to:

• Provide accurate and up-to-date information about their business
• Hold all licenses and authorizations necessary for their activity
• Comply with applicable legislation, particularly regarding consumer protection
• Respond to Client requests within a reasonable time
• Honor commitments made to Clients
• Not publish misleading or false content

MazalDay reserves the right to verify the information provided and remove any non-compliant profile.

All Users agree to:

• Use the Platform fairly and in accordance with its intended purpose
• Not publish unlawful, defamatory, offensive content or content that infringes third-party rights
• Not use the Platform for fraudulent purposes
• Not attempt to circumvent security measures
• Not collect personal data of other users
• Respect intellectual property rights

You are solely responsible for the Content you publish on the Platform. By publishing Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify and display such Content for the operation of the Platform.

You warrant that you have the necessary rights to the Content published and that it does not violate any third-party rights.

We reserve the right to remove any Content contrary to these Terms or applicable law, without notice or compensation.

The Platform and its content (excluding User Content) are protected by intellectual property rights. This includes:

• The MazalDay name, logo and trademark
• The design, structure and code of the Platform
• Texts, images and graphic elements created by MazalDay

Any unauthorized reproduction, representation or use is strictly prohibited and may result in legal action.

MazalDay acts as a simple technical intermediary. We are not responsible for:

• The quality, legality or compliance of services offered by Providers
• Disputes between Providers and Clients
• Direct or indirect damages resulting from the use of the Platform
• Service interruptions or technical malfunctions
• The accuracy of information provided by Providers

In all cases, our liability is limited to the amount of fees actually paid by the User in the last 12 months.

You agree to defend, indemnify and hold harmless MazalDay, its officers, employees and partners from any claim, damage, cost and expense (including attorney's fees) arising from:

• Your violation of these Terms
• Your violation of any third-party right
• Your use of the Platform
• Content you have published

You may terminate your account at any time from your profile settings or by contacting us.

We may suspend or terminate your access to the Platform, with or without notice, in case of:

• Violation of these Terms
• Fraudulent or illegal behavior
• Repeated complaints from other users
• Any other reason we deem necessary to protect the Platform or its users

Upon termination, sections relating to intellectual property, limitation of liability and indemnification remain in effect.

We reserve the right to modify these Terms at any time. Modifications take effect upon publication on the Platform.

For substantial modifications, we will notify you by email or via the Platform. Your continued use after notification constitutes acceptance of the new terms.

We recommend regularly checking this page to be aware of any modifications.

These Terms are governed by Israeli law.

Any dispute relating to the interpretation or execution of these Terms shall be subject to the exclusive jurisdiction of the courts of Tel Aviv, Israel, subject to mandatory provisions applicable to consumer protection.

For consumers residing in the European Union, the courts of the place of residence may also have jurisdiction in accordance with Regulation (EU) No 1215/2012.
